Annotation
The edition of the 135 Italian constitutional documents begins with the pre-revolutionary constitutional projects of Tuscany (Pietro Leopoldo Stati, 1787) and ends with the constitution drafts for the Kingdom of Lombardy-Venice (Statuto Costituzionale del Regno Lombardo-Veneto, 1850), now published for the first time. In Italy, during the periods of Jacobin and Napoleonic constitution making (17961814), the restoration phase (18151818) and the waves of revolutionary attempts (18201822, 18301832, 1848/49), a complex constitutionalism developed. Only fragmentarily researched until now, this constitutionalism reflected an array of European influences French Jacobinism, the British monarchy, the Spanish Constitution of Cadiz, the German Confederation, among others. With the volume Constitutional Documents of Italy and Malta 17871850, these documents are presented for the first time in collected and annotated form, supplemented by 8 documents of Malta. The following topics covered in this volume deserve special attention: the constitutional rhetoric of the "municipalit", the project of a special statute for Rome within the French Empire, the attempts of a restoration of the constitution of the Republic of Genoa or of a reception of the unwritten British constitution in Piedmont (1821), the constitutional projects of the Carbonari and, especially from a European perspective, the numerous failed projects of an Italian confederation of states. The documents have been edited in the Archivio di Diritto e Storia Costituzionali in Turin by Jrg Luther, who teaches public law at the University of East Piedmont.
